LOOSING YOUR DRIVER'S LICENSE IN NEW JERSEY____ncj
New Jersey passed a law on March 15, 1996, that requires the Probation Division of the Superior Court to take action to suspend the driver's, professional, or occupational license or any other license or certification required to work in New Jersey of any parent who: Has accumulated a child support arrearage that is equal to the amount of child support payable for six months & is not paying the arrearage through an income withholding or in accordance with a court-ordered payment schedule; Has failed to provide health insurance for a child or children within six months of being ordered to do so; Is subject of a warrant for failure to appear at a child support hearing or failure to comply with a child support order.
They sent this threat to all parents paying support through the probation department. Responsible Parents, who willingly and voluntarily support their children, were not exempt from the hit list. This is an additional insult to parents who are being denied visitations and receiving almost no help from the system.
New Jersey has no such law pending regarding any action being taken for those who: deny, entice, thwart, or interfere with visitations. They do not enforce the law in place, effective November 14, 1990, New Jersey Statue NJSA 2C:13-4(a) (Interference with custody).
To the best of my knowledge, only two people were ever found guilty of this statue, one physically removed her children from the state and the other received a $100.00 fine. Denial of visitations is also failure to comply with a court order. For some reason court orders regarding visitations have less meaning than those relating to support.
Many custodial parents feel we have punished them simply because we require that they allow the non-custodial parent a normal visitation schedule. Something they should have had in the first place.
I think it is safe to say, there really is no punishment for ongoing denial of visitations. It is not only the non-custodial parent being denied visitations but the children also. Children need what each parent has to offer. Children do not need to be used as a pawn and a weapon by bitter vengeful parents.
Children have the right to both parents.
